As is always the case with WorldNutdaily, there are unmentioned facts. The mother began her court issues after her child was apparently charged with assault. Hence, the judge may have concerns about the family circumstances. LINK

If the judge felt the children were abused or endanger he should have taken the kids out of the home. But to demand that the kids go to public school is overstepping his bounds.

Then I guess the question is whether there was something about the older two that she feared more than the ruling. Where they being picked on? Where they have emotional issues related to school?

Where they emotionally or physically in danger of abuse in that school district?

I am just trying to understand why she acted so desperately.

He probably felt they were being undersupervised. Judges in Juvenile and family court have wide discretion compared to adult courts.

I can't figure it out but I believe that acting so desperate can only hurt her case. It seems irrational.

I understand doing whatever it takes to stand up for your beliefs, however, if the actions of your child are already being questioned in court, and this would inevitably lead to your actions as a parent being questioned (rightly or wrongly), why would you do something that would lead the courts to further question your ability to be a responsible parent?

I don't think everyone sees sleeping on the floor for a short time as a big deal...

However, being forced into public school can be very traumatic for a child who has never been. Especially in the middle of the school year.

Since there are no mainstream articles, we can't really speculate on the details. One article I saw stated the 9 yo was charged with assault after hitting a child, but had completed all requirements (anger management class, etc) and the ONLY issue the judge had (a year later at a hearing to clear the charges) was that the school didn't have her affidavit. A school official did testify at one point that she had turned it in, but they lost it. I also believe I read that she had 24 hours left to enroll the kids in school before she left. Even though people were fighting to help her (I don't know if they began the fight before or after she fled), she did not have time left to fight it before enrolling them.

I agree with you here Tara.

I also wanted to give an update on this case. It was dismissed. Where's the clapping smiley? They are no longer living in Utah and are rebuilding. I'm sure prayers for this family are welcome.

I think she over-reacted. Granted, I don't believe anyone should be forced to put their kids in public school if they don't want to, but Utah apparently has guidelines in effect for homeschooling that weren't followed. After so many years, she probably assumed her faxed plan would reach its final destination. We have faxes all the time in our office that don't go through, so we've learned to follow up. She didn't follow up and now it looks like she never filed it.

The judge seems a little...aggressive...but a woman who will uproot her children and leave their home to take them across the country might be the kind of person to make comments in court that would annoy a judge. If I were her, I would have enrolled my children in public school until it could be worked out. The school year was half over by the time all this happened anyway, then she could file a new plan--and hand deliver it--before the fall.
